1. Definitions

• “Website” refers to naaryansh.com, owned and operated by Trend Gallery.
• “We”, “Us”, “Our” refers to Naaryansh.
• “You”, “Your”, “Customer” refers to the user or customer accessing or purchasing from our Website.
• “Products” refers to goods sold on our Website.
• “WooCommerce” refers to the e-commerce platform powering our store.
• “Razorpay” refers to the payment gateway processor.

2. Eligibility to Use

You represent and warrant that:

• You are at least 18 years of age or accessing the Website under the supervision of a parent or legal guardian.
• You have the legal capacity to enter into a contract under the Indian Contract Act, 1872.
• You will provide accurate, current, and complete information during the registration and checkout process.
• You will not use the Website for any unlawful purpose.

If you are under 18, you may use the Website only with the involvement of a parent or guardian.

3. Account Registration

• To place orders, you may need to create an account or checkout as a guest.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are fully responsible for all activities that occur under your account.

We reserve the right to refuse service, terminate accounts, or cancel orders at our sole discretion.

4. Products and Pricing

• Product Descriptions: We strive to display accurate product descriptions, images, and prices. However, we do not warrant that product descriptions or other content are error-free .
• Pricing: All prices are in Indian Rupees (INR) and include applicable GST as per Indian tax laws. Taxes are all pre calculated.
• Price Changes: We reserve the right to modify prices without prior notice. Such changes will not affect orders already confirmed.
• Availability: Products are subject to availability. If a product becomes unavailable after you place an order, we will notify you and offer an alternative or full refund.

5. Orders and Cancellations

• Order Confirmation: After placing an order, you will receive an email confirmation. This does not guarantee acceptance of your order.
• Order Acceptance: We reserve the right to accept or reject any order for any reason (e.g., stock unavailability, pricing errors, suspected fraud).
• Cancellation by Customer:
• Ready products: Cancellation allowed within 24 hours of order placement (if not yet shipped).
• Custom orders: Cancellation allowed only within 48 hours of order confirmation (before production starts).
• No cancellations once production has begun or order has been shipped.
• Cancellation by Us: If we cancel an order for any reason, we will issue a full refund via the original payment method.

6. Payments

We accept payments through Razorpay and Direct Bank Transfer (NEFT/RTGS/IMPS) .

Razorpay Payment Gateway

• All online payments (Credit/Debit Cards, UPI, Net Banking, Wallets) are processed through Razorpay , a PCI-DSS compliant payment gateway .
• Your payment information is encrypted and not stored on our servers.
• You agree to Razorpay’s Terms and Conditions and Privacy Policy available on their website .
• An 18% GST may be applicable on payment gateway fees as per Indian law .

Direct Bank Transfer

• Select “Direct Bank Transfer” at checkout.
• Transfer the exact amount to the bank details provided.
• Email the UTR/Transaction ID to [Your Email Address] for order confirmation.
• Orders are confirmed only after the amount is credited (typically 1-2 business hours for IMPS, 1 business day for NEFT).

UPI Payment

• Pay via your desired UPI app.
• Enter the transaction ID/number.
• Upload the screenshot.
• Orders are confirmed only after the amount is credited.

Payment Confirmation

Your order will be processed only after successful payment confirmation. We are not responsible for any bank or gateway delays.

7. Shipping and Delivery

• Orders are processed within 2 business days for ready products.
• Custom orders require 1-2 months (30-60 days) for production.
• We ship via DTDC and other regional courier partners.
• Delivery timelines are estimates and depend on the courier partner. We are not liable for delays caused by the courier partner, weather, strikes, or other unforeseen circumstances.
• Shipping charges (if any) will be displayed at checkout.
• Risk of loss passes to you upon delivery to the courier partner.

8. Returns and Refunds

• General Items: We do NOT accept returns for change of mind, size issues, or personal reasons.
• Defective Products: Returns are accepted ONLY for manufacturing defects with a 4K unboxing video submitted within 48 hours of delivery.
• Refunds: Issued ONLY for unfulfilled orders.
• Custom Orders: No returns or refunds once production begins.

9. User Conduct and Prohibited Activities

You agree NOT to:

• Use the Website for any unlawful purpose or in violation of Indian law.
• Upload or transmit viruses, malware, or harmful code.
• Attempt to gain unauthorized access to our systems.
• Harass, abuse, or harm another person.
• Post false, misleading, or fraudulent information.
• Infringe upon our intellectual property or that of third parties .

Violation of these terms may result in immediate termination of your access and legal action.

10. Intellectual Property

All content on this Website, including text, graphics, logos, images, product designs, and software, is the property of Naaryansh or its content suppliers and is protected by Indian copyright and trademark laws.

You may not reproduce, distribute, modify, or create derivative works without our express written consent.

11. Limitation of Liability

To the maximum extent permitted by Indian law:

• Our total liability to you for any claim arising out of these Terms shall not exceed the amount paid by you for the specific product giving rise to the claim .
• We shall not be liable for any indirect, incidental, special, or consequential damages, including loss of profits, data, or goodwill.
• We do not warrant that the Website will be uninterrupted, error-free, or secure.

Nothing in this clause limits our liability for death, personal injury, or fraud.

12. Disclaimer of Warranties

The Website and all products are provided on an “AS IS” and “AS AVAILABLE” basis . We make no representations or warranties of any kind, express or implied, regarding:

• The operation or availability of the Website.
• The accuracy, reliability, or completeness of any content.
• The quality or fitness for a particular purpose of any product (except as expressly provided).

We do not warrant that defects will be corrected or that the Website is free of viruses.

13. Indemnification

You agree to indemnify, defend, and hold harmless Naaryansh , its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from:

• Your violation of these Terms.
• Your violation of any applicable law.
• Your use of the Website or products.
• Your infringement of any third-party rights.

14. Grievance Redressal and Contact Information

As required under the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology (Intermediary Guidelines) Rules, 2021 , we have established a grievance redressal mechanism .

All grievances must be submitted in writing with your order number and a clear description of the issue.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India.

Any dispute arising out of or relating to these Terms or your use of the Website shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, the dispute shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 .

The arbitration shall be conducted in Lucknow in the English language. The arbitrator’s award shall be final and binding.

Courts in Lucknow shall have exclusive jurisdiction for any matters not subject to arbitration.

16. Force Majeure

We shall not be liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, civil unrest, pandemics, government actions, strikes, or failure of courier partners or payment gateways.

17. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on this page, with the “Last Updated” date revised accordingly.

Your continued use of the Website after changes constitutes acceptance of the modified Terms. For material changes, we may provide additional notice via email or website notification.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy , Refunds & Returns Policy , and Shipping & Payments Policy , constitute the entire agreement between you and Naaryansh regarding your use of the Website and purchase of products.
